Agreement
This Agreement, which includes the Enrollment Form, is a contract which establishes the rules which cover your electronic access to your accounts at First National Bank in Altus (First National) through FirstNet Banking (FirstNet).  By using FirstNet, you accept all the terms and conditions of this Agreement.  Please read it carefully.
 
The terms and conditions of the deposit agreements and disclosures for each of your First National accounts as well as your other agreements with First National such as loans continue to apply notwithstanding anything to the contrary in this Agreement.
 
This Agreement is also subject to applicable federal laws and the laws of the State of Oklahoma (except to the extent this Agreement can and do vary such rules or laws).  If any provision of this Agreement is found to be unenforceable according to its terms, all remaining provisions will continue in full force and effect.  The headings in this Agreement are for convenience or reference only and will not govern the interpretation of the provisions.  Any waiver (express or implied) by either party of any default or breach of this Agreement must be in writing and shall not constitute a waiver of any other or subsequent default or breach.  You may not assign this Agreement.  This Agreement is binding upon your heirs and First National's successors and assigns.  Certain of the obligations of the parties pursuant to this Agreement shall survive termination, cancellation or expiration of this Agreement.  This Agreement, together with the Enrollment Form, constitutes the entire agreement between you and First National with respect to the subject matter hereof and there are no understandings or agreements relative hereto which are not fully expressed herein.
 
Definitions
"Access ID" is a unique user code – you will designate your Access ID at the time of enrollment.  The ID must be at least 6 characters and not more than 19 and must end with the last three digits of your primary account number.
 
"Account or Accounts" means your accounts at First National Bank.
 
"Business Days" mean Monday thru Friday.  Holidays are not included.
 
"Electronic Funds transfers" mean ATM withdrawals, preauthorized transactions, point of sale transactions, and transfers to and from your First National accounts using FirstNet Banking.
 
"Password" is the temporary code provided to you by First National for use during the initial sign-on process, and the code you personally must select that establishes your connection to Personal Online Banking.
 
"Payment Account" means any online checking account at First National that was established primarily for personal or household purposes, from which you will be conducting Personal Online Banking transactions.
 
"System Services" means the services provided pursuant to this Agreement.
 
"We", "Our", "Us", or "Bank" refers to First National Bank in Altus. 
 
"You" & "Your" refer to the account holder authorized by First National Bank to use FirstNet Banking under this Agreement and anyone else authorized by that account holder to exercise control over the account holder's funds through FirstNet Banking.
 
Access
To use FirstNet, you must have an account at First National, access to Internet service, and an e-mail address. Once we have received your signed Enrollment Form, and verified your account information, we will send you, by U.S. Postal Service, confirmation of our acceptance of your enrollment, along with your temporary password.  FirstNet can be used to access all accounts of which you are a legal owner or authorized signer and that are contained in your personal portfolio with First National Bank.  You can delete any of your First National accounts from viewing over the internet by listing them as "Non-Viewable" on your Enrollment Form.  Access to your accounts through FirstNet will be based upon the identification of users specified by you in your Enrollment Form.  We undertake no obligation to monitor transactions through FirstNet to determine that they are made on behalf of the account holder.
 
FirstNet Services
You can use FirstNet to check the balance of your First National deposit accounts, view account histories, and transfer funds between your First National accounts. If you are enrolled in Bill Pay you can direct payment from your payment account to businesses or individuals that you wish to pay.
 
New services may be introduced for use with Personal Online Banking from time to time.  We will notify you of the existence of these new services by placing information on our website.  By using these services when they become available, you agree to be bound by the rules posted to our website that will be made available to you concerning these services.
 
Bill Payment Service 
In addition to FirstNet Internet Banking, you may elect to use Bill Pay.  To access the Bill Pay service you must have a personal checking account with First National.  Bill Pay is optional, however if you sign up for Internet Banking, you automatically have the ability to access Bill Pay.  If you choose to enable the service Bill Pay allows you to make payments electronically from your "linked" checking accounts with First National to third parties.  You may make payments through Bill Pay to businesses that generate a bill or invoice for products or services provided to you, or individual payees that have an address we can verify.
 
The "Payment Date" is the date you enter into Bill Pay when setting up a bill payment.  You may set up single payments and recurring payments.  A single payment is a payment to be made to a payee one time.  Recurring payments are payments for a fixed amount made to a single payee at recurring intervals (e.g., weekly, semi-monthly, monthly, quarterly, semi-annually, or annually).
 
All payments you make will be deducted from the account that you designate, which becomes the Payment Account.  Funds will be deducted from the Payment Account on the business day you designate as the "Payment Date". Any payments you wish to make through Bill Pay must be payable in U.S. dollars to a payee located in the continental United States.  Payments for time-sensitive payees will be your sole responsibility if delayed or improperly processed or credited.  We reserve the right to restrict types of payees to whom payments may be made using Bill Pay from time to time.  You should not use the Bill Payment Service to make payments to settle securities purchases, the IRS or other tax payments, or court ordered payments.
 
Funds must be available in your designated Payment Account on the scheduled Payment Date.  After funds are withdrawn to make a payment, we may make the payment either by transferring funds electronically or by mailing the payee a check.  The Payment Account is debited on the Payment Date, which will be earlier than the date the payment is received by the payee.  If the Payment Date falls on a non-business day (e.g., Saturday, Sunday or holiday), the payment will be sent on the next business day.
 
If your Payment Account does not have sufficient available funds to make a payment on the day a payment is scheduled, we will try to complete the payment on each of the next two business days.  If there are still insufficient funds on the third attempt the payment will be canceled and no further attempt will be made by First National to make the payment.  First National shall have no obligation or liability if it does not complete a transfer or payment because there are insufficient available funds in your Payment Account to process a transaction.  In all cases, you are responsible for either making alternative arrangements for the payment or rescheduling the payment through the Bill Payment Service.  In the case of recurring payments, only the payment currently scheduled will be canceled.  Recurring payments scheduled for future dates will not be affected.
 
You should schedule payments in advance to provide at least (7) business days before any payment due date (that is, the due date shown on your invoice or provided in your agreement with the payee, not taking into account any applicable grace period).  If you do not, you will be fully responsible for all late fees, finance charges or other action taken by the payee. 
 
If the FirstNet session during which you schedule a payment or transfer ends by 6:00 p.m. CST, First National will be considered to have received it on that day.  Otherwise, it will be considered received the following business day.  For all entries made using FirstNet, the time (central standard) recorded by FirstNet service controls.
 
First National will not be liable in any way for delays in mail delivery, for changes to the payee's address or account number (unless you have advised us of the change sufficiently in advance), for the failure of any payee to correctly account for or credit the payment in a timely manner, or for any other circumstances beyond the control of First National.
 
You may cancel or change a payment using the Bill Payment Service.  Payments must be changed or canceled using the Bill Payment Service prior to 6:00 p.m. on the business day the transaction is scheduled to be made.  If you wish to cancel a payment after it is issued please call customer service at 580-482-7700.  If we agree to stop the payment, you will be charged a stop payment fee as detailed in our Common and Miscellaneous Fees.
 
Hours of Access
You can use FirstNet seven days a week, twenty-four hours a day, although some or all of FirstNet services may not be available occasionally due to emergency or scheduled system maintenance.  We agree to post notice of any extended periods of non-availability on our website.
 
Your Password
For security purposes, you are required to change your password upon your initial log in to FirstNet.  You determine what password you will use and the identity of your password is not communicated to us.  You will be required to change your password every six months, however; you can change your Password at any time by selecting the "Change Password" option in FirstNet.  You agree that we are authorized to act on instructions received under your password.  After five (5) unsuccessful attempts to use your password, your access to FirstNet will be revoked.  To re-establish your authorization to use FirstNet, you must contact us to have your password reset or to obtain a new temporary password.  You agree to assume responsibility for all transactions conducted by other persons to whom you have given your Access ID and password.
 
Your case-sensitive password must be at least six keystrokes in length must not exceed ten keystrokes and must be alpha and numeric.  Your password should not be associated with any commonly known personal identification, such as social security numbers, address, date of birth, names of children and should be memorized rather than written down.
 
Security
You understand the importance of your role in preventing misuse of your accounts through FirstNet and you agree to promptly examine your statement for each of your First National accounts as soon as you receive it.  You agree to protect the confidentiality of your account and account number, and your personal identification information, such as your driver's license number and social security number.  You understand that personal identification information by itself, or together with information related to your account, may allow unauthorized access to your account.  Your password and log in ID are intended to provide security against unauthorized access to your accounts.  Data transferred via FirstNet is encrypted in an effort to provide transmission security and FirstNet utilizes identification technology to verify that the sender and receiver of FirstNet transmissions can be appropriately identified by each other.  Notwithstanding our efforts to insure that the FirstNet system is secure, you acknowledge that the Internet is inherently insecure and that all data transfers, including electronic mail, occur openly on the Internet and potentially can be monitored and read by others.  We cannot and do not warrant that all data transfers utilizing FirstNet, or e-mail transmitted to and from us, will not be monitored or read by others.
 
Fees and Charges
You agree to pay the fees and charges for your use of FirstNet and Bill Pay Services as set forth in the current fee schedule.  You agree that all such fees and charges will be deducted from your First National checking account.  You agree to pay any additional reasonable charges for services you request which are not covered by this Agreement.  You are also responsible for telephone and Internet service fees you incur in connection with your use of FirstNet.
 
Posting of Transfers
Transfers initiated through FirstNet before 6:00 p.m. CST on a business day are posted to your account the same day.  Transfers completed after 6:00 p.m. CST on a business day, Saturday, Sunday, or banking holiday, will be posted on the next business day.
 
FirstNet identifies transfers based upon the log in ID of the user who made the electronic transfer.  Furthermore, you understand and acknowledge that transfers made by another authorized user of your account may not be visible to you until they are posted if different log in IDs are used.  You agree to communicate with any other persons with authorized access to your accounts concerning any transfers from your accounts in order to avoid overdrafts.
 
Overdrafts (Order of Payments, Transfers, and other Withdrawals
If your account has insufficient funds to perform all electronic fund transfers you have requested for a given business day, then:
 
Limits on Amounts and Frequency of FirstNet Transactions
The number of transfers from First National accounts and the amounts which may be transferred are limited pursuant to the terms of the applicable deposit agreement and disclosure for those accounts.  If a hold has been placed on deposits made to an account from which you wish to transfer funds, you cannot transfer the portion of the funds held until the hold expires.
 
Periodic Statements
You will not receive a separate FirstNet statement. Transfers to and from your accounts using FirstNet will appear on the respective periodic statements for your First National accounts. 
 
Change in Terms
We may change any term of this Agreement at any time.  If the change would result in increased fees for any FirstNet service, increased liability for you, fewer types of available electronic fund transfers, or stricter limitations on the frequency or dollar amount of transfers, we agree to give you notice at least thirty (30) days before the effective date of any such change, unless an immediate change is necessary to maintain the security of an account or our electronic fund transfer system.  We will post any required notice of the change in terms on the First National Bank website or forward it to you by e-mail or by postal mail.  If advance notice of the change is not required, and disclosure does not jeopardize the security of the account or our electronic fund transfer system, we will notify you of the change in terms within thirty (30) days after the change becomes effective.  Your continued use of any or all of the subject FirstNet services indicates your acceptance of the change in terms.  We reserve the right to waive, reduce or reverse charges or fees in individual situations.  You acknowledge and agree that changes to fees applicable to specific accounts are governed by the applicable deposit agreements and disclosures.

We make no warranty of any kind, express or implied, including any implied warrant of merchantability or fitness for a particular purpose, in connection with FirstNet services provided to you under this Agreement.  We do not and cannot warrant that FirstNet will operate without errors, or that any or all FirstNet services will be available and operational at all times.  Except as specifically provided in this Agreement, or otherwise required by law, you agree that our officers, directors, employees, agents, or contractors are not liable for any indirect, incidental, special or consequential damages under or by reason of any services or products provided under this Agreement or by reason of your use of or access to FirstNet, including loss of profits, revenue, data or use by you or any third party, whether in an action in contract or tort or based on a warranty.  Further, in no event shall the liability of First National Bank and its affiliates exceed the amounts paid by you for the services provided to you through FirstNet.
 
Your Right to Terminate
You may cancel your FirstNet or Bill Pay service at any time by providing us with written notice.  Your access to FirstNet or Bill Pay will be suspended within three (3) business days of our receipt of your instructions to cancel the service.  You will remain responsible for all outstanding fees and charges incurred prior to the date of cancellation.
 
Our Right to Terminate
You agree that we can terminate or limit your access to FirstNet services for any of the following reasons:

  1. Without prior notice, if you have insufficient funds in any one of your First National accounts.

    FirstNet services may be reinstated, in our sole discretion, once     sufficient funds are available to cover any fees, pending transfers and         debits.
  2. Upon three (3) business days notice if you do not contact us to designate a new Primary Checking account immediately after you close your Primary Checking Account.
  3. Upon reasonable notice, for any other reason in our sole discretion.

You agree that any notice or other type of communication provided to you pursuant to the terms of this Agreement, and any future disclosures required by law, including electronic fund transfer disclosures, may be made electronically by posting the notice on the First National website or by e-mail.  You agree to notify us immediately of any change in your e-mail address.
